Fast forward to this foundation of legislation get's it's moment to shine, farm Bill. The Farm Bill legalized hemp production, it did not explicitly legalize THCA (tetrahydrocannabinolic acid), which is the precursor to THC found in raw cannabis plants. However, the legalization of hemp opened up opportunities for the extraction and processing of various cannabinoids, including THCA, from hemp plants.
Under the Farm Bill, hemp is defined as cannabis plants and derivatives containing no more than 0.3% THC by dry weight. This distinction is crucial because THCA itself is not psychoactive until it is heated and decarboxylated into THC. As long as hemp-derived products, including those containing THCA, comply with the legal definition of hemp and contain less than 0.3% THC, they are considered legal under federal law.
