The Kentucky Cannabis Lawyer
If you watched our latest episode on Spotify & YouTube, I sat and puffed up a intriguing conversation with well diverse lawyer by the name of Brad Clark. He is the managing operator of Kentucky Cannabis Lawyer. This was a deep dive into how the cannabis map of Kentucky is being formed. With many focused on the over-bidding, or the "stacking the lottery" that took place- the fact is we press on with what is. Clark reps some of the very companies that will be bringing Kentuckians Dispensary THC products.
Until the day the green ribbons are cut, the only flower one can smoke in Kentucky, is THCA flower. As I've spoke to several store owners each on different ends of Kentucky, some will not sell, while others press the envelope. So why is one store owner convinced the law forbids the sell of THCA flower below 3% DELTA 9, whilst another has the pre rolls all day no sweat? It doesn't seem to be the cops biggest priority, and Brad Clark agrees. I posed the question how these sales can take place, and even better yet, how is USPS able to deliver it to Kentuckians doorsteps?
Is It Constitutional
The questioned seemed to be one that requires a multi layered approach as the law doesn't seem to be in one solid direction yay or no, in fact this very situation dangles in the courts room as I type this. Due to the farm bill, the hemp cannot be interfered with, it's about the testing at a certain stage, and due to how the law tends to test THCA products, there isn't a way for law enforcement to pin point what is legal, and what isn't. As of now, the way the law is written, one could Order THCA flower, and get it delivered straight to their door. By the way, big shout out to Jam'n Hemp, and Boston's Buds, you can find THCA FLOWER there. The argument in court, could perhaps be, whether the arrests, and penalizations are constitutional, with the 2018 Farm Bill being, well, a real thing. Be sure to check that episode out!
Tune In - Ask Questions
Brad Clark appears to be an open book for the most part, his profession understandably has shaped some answers. I myself, have pondered new questions since that conversation. What is the route to ensure more opportunity's, for middle class family's, to open grow facility's in the future. In our conversation you mention how strapped we will be when it comes to sourcing and growing cannabis. This leaves room for growth, this can be a positive thing.
Are there any ways we can press the state government to pardon anyone that's been charged with non violent crimes when this state finally goes rec.
